corporate (us, we, our) maintain a policy of strict confidence concerning
your (you, your) personal information (Privacy
Policy).
This Privacy Policy has been developed in accordance with the Privacy Act 1988 (Cth) (Privacy Act). This Privacy Policy applies to the collection, storage, use and dissemination of your personal information by us. The term “personal information”, as used in this Privacy Policy, is as defined under the Privacy Act.
By providing personal
information to us and having access to this Privacy Policy, either directly by
accessing the I Heart Songwriting
Club site (Site),
or our platform (Platform),
or indirectly through a business partner or service provider, you accept the terms of this Privacy Policy.
Collecting personal information The personal information you provide to us is collected to enable us to provide our services, to enhance your use of the Site and the Platform, to improve the Site and the Platform, and to keep you informed of our products and services that might be relevant to you. The types of personal information we collect from you may include your name, email address, physical address, password, billing postcode, gender, birthdate, phone number, historical songwriting information and credit card or other payment details. We will generally collect personal information directly from you (or your parent/guardian if you are under 18 years of age). We may collect your personal information in any of the following ways:
- when you log on or access our Site or Platform;
- during conversations and/or correspondence between you and our customer service team;
- when you sign up for or attend one of our events or any partner events (including via event ticketing partners);
- when you participate in our services (including coaching and/or mentorship services, audio calls, audio-visual calls and your submission of Content); and
- when you otherwise elect to provide personal information to us.
Your credit or debit card
information is stored using our third party payment provider, Stripe, and never
stored by us. By Subscribing to I Heart Songwriting Club, You also agree to be
bound by Stripe’s policies, including its privacy policy, available at https://stripe.com/au/legal.
Your personal information may be
lawfully provided to us by third parties, including if you sign up to our
services or provide authentication via Facebook or Google. If someone other than you provides us with
personal information about you that we did not ask for, and we could not have
collected this personal information, we will lawfully de-identify or destroy
that personal information.
Your Content We may also access information, data, text,
photographs, videos, audio clips, written posts, comments and creative and
literary works which you submit on or through the Platform (Content)
which may include personal information. Your Content may be published on the
Platform and other members may also have access to your Content as a
requirement for us to provide our services. We use best efforts to ensure that
only members assigned to your group, along with our administration and
technical support officers, have access to your Content. You acknowledge that
as a member of our community your Content may remain on our Platform even if any
paid subscription expires. This is required to enable us to provide our
services and to facilitate ongoing communication and feedback within your
group.
Cookies When
you visit the Site or Platform we may attach a “cookie” to your computer’s
memory. This “cookie” is a small text file which assists us to store session
information when you are logged into the Site or Platform and to facilitate
seamless access between our different services. If you choose to do so, you should be able to
configure your computer so that it disables “cookies” or does not accept them,
however, this may impact the functionality of the Site or Platform. Some
cookies are deleted when you close down your browser. These are known as
session cookies. Others remain on your device until they expire or you delete
them from your cache. These are known as persistent cookies and enable us to
remember things about you as a returning visitor.
We may also use third-party tools for collecting
and analysing data related to your visit to our Site that does not personally
or directly identify you. Google
Analytics will track certain information about you in the course of you using
this website, such as your IP address and browser identification. This
information is used only to improve your user experience. Google has
developed the Google Analytics Opt-out Browser Add-on which you can use to
opt-out of Google Analytics.

information will be securely stored by us. We will only collect, store,
use or disclose your personal information as set out in this Privacy Policy and
where we are required by law to protect our rights or property (or those of any
third party), or to avoid injury to any person. We will not disclose your
personal information to any third party other than in accordance with this
Privacy Policy. We may transfer your personal information to our hosting
partners and other service providers who assist us in operating our Site and
Platform, conducting our business, providing our services, and helping us
communicate with you. We may share your personal information with
entities which partner with us for online and/or physical events. We take
reasonable steps to ensure that these organisations comply with technical and
organisational security measures required to protect your personal
information.
Communicating with you We may use your personal information to send you
information about new developments, products, services and special offers. You
can, at any time, opt out of receiving marketing material from us by contacting
us using the method set out below or, where we have sent you electronic

material, we will still send you essential information that we are required to send
you relating to the services we provide.

using the method set out below. If we no longer need your personal information,
unless we are required under law or a court or tribunal order to retain it, we
will take reasonable steps to de-identify or destroy your personal information
securely, subject to our requirements in respect of your Content and our
requirements to retain data to comply with our legal obligations and financial
and audit obligations.
Access to information we hold about
you We will take reasonable steps to
ensure that all your personal information we hold is accurate, up-to-date and
relevant. You can request access to, corrections of, or erasure of your
personal information held by us, or complain or object to the use of your personal
information by us. If you are a member of the Platform, you can update some of
your personal information using the functionality of the Platform. You can also
contact us using the method set out below. We will respond to your request as
quickly as possible.

not identify yourself or to use a pseudonym. However, this will not apply if it
is impracticable for us to communicate with you that way or we are required or
authorised under law (or a court or tribunal order) to only deal with

with any applicable laws, to reflect changes in our processes or for any other
reason at any time. Material changes in our Privacy Policy may be communicated
to you, but we also encourage you to check our Privacy Policy periodically to
read about any variations. You will be deemed to have consented to such
variations by your continued use of the Site and/or the Platform following such

in the European Union We welcome customers
from the EU and we are committed to compliance with the EU General Data
Protection Regulation (GDPR).

are based on the legitimate interests pursued by us in providing services to

Personal information transferred outside of the European Union: The personal information of customers located in the EU may be transferred outside of the EU to our hosting providers and other service providers we have engaged to support our business. Please refer to the “Use and disclosure of information” section of this Privacy Policy. In particular, your personal data may be stored in the USA with Google Cloud in the us-central1-c zone. Google is certified under the EU-U.S. Privacy Shield. We will ensure that appropriate safeguards exist in relation to transfers of personal information to other service providers outside of the EU.
